Mike Golden, Facilitator, started the meeting by having the group introduce themselves. Golden
explained his job as facilitator and how to make the process work.

Martha Pagel gave an update on the Confidentiality Committee.
Pagel noted that, Chapter 690, Division 4, Procedural Rules for Mediation Communications have
been signed and were in place as temporary rules, effective May 11, 1998.
Reed Marbut noted that a hearing on the proposed permanent rules will be held at the July ADR
meeting.
Jim Carpenter gave an update on the Concepts Committee.
The Operating Principles, Confidentially and Concepts Committee met.
DEPT. OF ENVIRONMENTAL QUALITY PRESENTATION
Dick Nichols, Department of Environmental Quality, gave a presentation on water availability
requirements under the Clean Water Act, including the concepts of Total Maximum Daily Load
(TMDL). TMDL is the sum of allowable pollutant loads to a body of water based on its waste
assimilative capacity. Assimilative capacity is the amount of pollutant that can be discharged into
the environment without impairing the beneficial uses. He went on to discuss the beneficial uses
for the Klamath Basin, point source and non-point sources, TMDL components, the TMDL
process and implementation.
DEPT. OF AGRICULTURE PRESENTATION
Ray Jaindl, Department of Agriculture, gave a presentation on SB 1010. SB 1010 provides the
Department of Agriculture with authority to develop and implement agricultural water quality
management area plans. He also discussed the requirements of an agricultural water quality
management area plan, makeup of local advisory committees, process for implementing SB 1010
in water quality limited basins, and the draft schedule for the development of agricultural water
quality management area plans.
DISCUSS TRIBAL SETTLEMENT CONCEPT
Walter Echo-Hawk, Native American Rights Fund, discussed the Tribal Settlement Concept. He
discussed the affected groups and listed committees who will be working in these areas.

REVIEW AND ADOPT OPERATING PRINCIPLES
The Review and adoption of the Operating Principles has been postponed until further discussion
has taken place.
OTHER BUSINESS
Martha Pagel said that the Emergency Board will meet again June 11, 1998 to discuss funding for
the adjudication process.
The next Water Resources Commission meeting will be held July 9 and 10, and will be in Klamath
Falls at OIT.
Martha expressed that she doesn't want people to feel that they need a lawyer to attend the ADR
meetings. She encouraged everyone to stay on the mailing list and come to the meetings. Some
concerns were raised regarding the amount of money being spent on lawyers attending the
meetings.
The next meeting is scheduled for June 9 at 10:00 a.m., and will be held at the Klamath County
Fairgrounds.
