 Brian PosewitzWaterWatch of OregonThe application should be denied because the water right to be leased, C4120, is required to be converted to a permanent instream water right under ORS 543A.305. The water right is a hydroelectric water right and use of water under the water right ceased more than five years ago - in 2003 at the latest, which is when the federal license for the related hydroelectric facility was surrendered. Later instream leases did not avoid the conversion requirement because they did not change the fact that the hydroelectric use ceased and because they are not use of water under a hydroelectric water right. Moreover, ORS 543A.305 does not include instream leases among the exceptions to the conversion requirement.
