However, The transfer should not be granted unless the applicant can demonstrate that it will "complet[e]" "the change requested in [the] transfer application" (meaning complete the diversion at the new location and put all of the water to beneficial use) or otherwise "justify" a longer time period. OAR 690-380-5140(3). In this case, the applicant should be required to show that it needs, and will use, all of the portion of the water right to be transferred within five years. Transfers, like initial water rights, should be approved only for present beneficial uses. If necessary to satisfy this standard, the applicant should be required to show, and the permit should be conditioned to require, that it will discontinue use of other sources of water upon completion of the transfer.
 Barbara JacobsonCity of WilsonvilleAlthough the City of Wilsonville, as land owner has no objection to the transfer, the point of diversion will not be allowed through the Wilsonville intake facility. As noted on the land use form already submitted, as outlined in comments by Wilsonville, Wilsonville has NOT consented to a point of diversion for this transfer in Wilsonville. The Intake Facility at Wilsonville is governed by an intergovenmental agreement whereby only the parties to that agreement are allowed to come in through that intake facility and the City of Cornelius is not party to that agreement, is not anticipated to become party to that agreement and therefore will not be allowed to use the Wilsonville facility or land in conjunction with the proposed transfer.
