Ensure consistency with conditions in prior extension orders, including the order of May 13, 2002, saying any future extension may be denied without proof that static water levels have been submitted annually. 2. Ensure consistency with federal permits, including conditions for protection of ESA-listed species, necessary to complete development of the permit. Our understanding is that U.S. Army Corps of engineers permits may be forthcoming along with a biological opinion from the National Marine Fisheries Service regarding conditions required to protect ESA-listed species. Consider waiting for those conditions before issuing any proposed final order to allow inclusion of additional appropriate conditions. 3. Consider if there is good cause for an extension in light of the time since initial permit issuance and the expectation, included in statute, that the permit would be fully developed within five years from issuance.
