 David FordEagle Point Irrigation DistrictIS 88951 Reese cr. North fork of Reese cr. and the South fork of Reese cr. are seasonal streams. The actual source of the summer time flows is certificated irrigation water and there is no additional available water in this basin. The methodology for determining the requested stream flows is simply inaccurate and unrealistic with no real data to substantiate the claim. Even though the this is a non-consumptive application, the proposed use is not compatible with the current certificated use and will most likely incite future conflict of the two competing water rights when flows are low. Layering on District water rights creates an unnecessary hardship on the Districts when transferring water rights. For these reasons the application should at least be amended to reflect months outside of irrigation season.
 Richard NawaKlamath Siskiyou Wildlands CenterThis application specific comment is intended to be reviewed in conjunction with KS Wild comment letter dated February 17, 2021 which emphasizes the public benefit of the application and recent research finding concerning “natural flows”. We concur with WRD initial review to approve. The amounts allowed by WRD are less than those requested by ODFW for December. December is an important month for salmon/steelhead migration. High pulses of flow are needed to move fish to spawning areas. KS Wild recommends that ODFW and WRD discuss these discrepancies amicably and proceed to issue a proposed final order.
