 Brian PosewitzWaterWatch of OregonThe proposed new POD may allow use of water in excess of what has been allowed at the current POD due to a bypass flow requirement in the right of way agreement for the existing POD. If so, the proposed transfer would result in enlargement of the use and, as a result, injury to other existing water rights. To the extent the proposed transfer is neverthless allowed, it should be conditioned to include all conditions on the diversion at the existing POD, including conditions imposed by the right of way agreement and any other applicable agreement, permit, approval or the like, even if not conditions of the water rights themselves.
