According to ORS 537.143, "uses eligible for a limited license shall be for a short-term or fixed duration." The OWRD website explains: "A limited license allows landowners and developers to use water for purposes that do not require a permanent water right, such as to provide water to establish a crop that requires no further irrigation after the crop is established, road construction, and emergency use." https://www.oregon.gov/owrd/programs/waterrights/otherauth/pages/ll.aspx The use described in this application is municipal use. There is currently another applicable limited license, LL-1779, that is expiring, for the same use. Approval of this application would extend that municipal use for another 5 years. Ten years of municipal use is not the one-time, temporary use intended by the limited license statute. These uses require a permanent water right. The applicant explains that this use is to cover the waiting time until an extension of time for permit G-12134 is approved. The applicant also explains that the water rights transactions to provide the authorization for municipal use under that permit are expected to take several additional years. A permit amendment application still must be submitted. Applicant is using the limited license as a "bridge" to a future situation that may not materialize. The water transactions may not occur, and the extension of time and permit amendment applications may not be granted. The timeline is unknown. This is not the certain and finite purpose intended by the limited license statute. Thank you.
