 Kimberley PriestleyWaterWatch of OregonThank you for the opportunity to comment on LL-1985 which is seeking use of 444 acre feet (at a rate of 1.86 cfs) from Galesville Reservoir for industrial use for the time period of July 1, 2024 to December 3, 2024. The proposed period of use is inconsistent with the Umpqua Basin Program Rules which restrict the use of stored water for the South Umpqua and its tributaries to, among other things, water “legally released from storage from July 15 through September 30 of each year.” OAR 690-516-0005(1)(e). This application is for time period beyond the September 30th cutoff date. If the OWRD issues this limited license, the use must conform with the basin plan restrictions. Moreover, it appears that this is a repeat limited license. Limited licenses can only be issued for uses that are of short term or limited duration. ORS 537.143. The OWRD cannot issue limited licenses that serve long term uses, or as “bridges” while applicants seek other water rights. As such, the OWRD should deny this application.
