1. The proposed reservoir cannot reasonably meet all conditions required to prevent significant detrimental impact to existing fishery resources. Water that would otherwise contribute to flows in Abiqua Creek and downstream waters (through rainfall onto the site, flows in what is left of Evans Creek, and/or groundwater seepage) will reach the reservoir outside the recommended storage season (November through May). Without conditions to require measurement of inflow and outflow and regular monitoring, that water will inevitably be stored, contrary to the recommended limited storage season. Even if water reaching the reservoir outside the storage season were released, it would inevitably be water-quality impaired because the reservoir water will be too warm to meet water quality standards June-October and will likely be polluted by associated land uses, in violition of the recommended condition on release of polluted water. The reservoir, which is unlined, will also inevitably release polluted water to downstream waters through subsurface seepage. The application should therefore be denied. 2. Any permit issued should include all conditions recommended by ODFW. 3. Any permit issued should also include a condition requiring measurement of inflow and outflow to ensure compliance with the recommended limited storage season. 4. Any permit issued should also include a condition requiring third-party monitoring and reporting of the water quality in the reservoir and discharges from the reservoir to ensure compliance with water quality conditions.
